Westchester DWI Offenses

Driving while intoxicated is taken very seriously in Westchester County, throughout New York State, and across the entire country. Law enforcement and court systems aim to hold drunk drivers accountable for putting the lives of everyone on the road at risk. Driving while intoxicated is one of the leading causes of fatal motor vehicle accidents. When an individual is convicted of driving while intoxicated, they are facing serious penalties. Though the penalties are quite serious on a first offense, individuals who have more than one offense for driving under the influence will face even more severe consequences.

If a driver is found to have a blood alcohol content that is greater than 0.08 percent, they will be charged with driving while intoxicated. It is important to note that this is only true when the driver is above the legal drinking age of 21. In addition, if a driver is operating a commercial vehicle, they can get a DWI if they have a blood alcohol content level of 0.04 percent or higher. Individuals who are under 21 years of age can be charged with driving while intoxicated with a BAC of 0.02 percent or higher.
